Through this document, Models Factory® aims to communicate and disclose how it processes personal data, as well as inform data subjects of their rights under Regula=on (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016, applicable from 25 May 2018 (hereina]er GDPR or the Regula=on), and Law No. 58/2019, of 8 August.
The GDPR sets out rules on the protec=on of individuals with regard to the processing of personal data and on the free movement of such data. The specific data processed and how they are used will depend primarily on the services requested and the respec=ve processing purposes.
Models Factory® guarantees that personal data is processed in strict compliance with individual rights and current legisla=on. Data processing is carried out only to the extent necessary for the company’s objec=ves and to maintain a high standard of service.

2. What personal data does Models Factory® process and what are the respective sources?
2.1. Models Factory® processes the following personal data:
a. Data received during the process of contrac=ng services offered by the company to its talents or during the execution of contractual relationships with talents and/or clients (Article 6(1)(b) GDPR).
b. Data processed in compliance with legal and regulatory obligations (Article 6(1)(c) GDPR).
c. Data provided by third par=es when relevant to the provision of services, contract compliance, or fulfilling legal obligations.
e. Based on legitimate interests pursued by the data controller or third parties (Article 6(1)(f) GDPR).
f. Based on the prior and explicit consent of the data subject, where applicable (Article 6(1)(a) GDPR).
For individuals under 16 years of age, consent must be provided by the holder(s) of parental responsibilities.
2.2. Categories of personal data collected and processed by Models Factory® include:
- A) EMPLOYEES
- Name; date of birth; gender; marital status; number of dependents; national ID number; tax identification number; social security number; address; telephone/mobile number; email address; job title; remuneration; bank account number; photograph; CV; education/ training certificates.
- B) TALENTS
- Registration for agency contact: name; date of birth; gender; address; photographs; telephone/mobile number; email address; physical characteristics (height, clothing sizes, eye and hair colour); sports and talents; photographs.
- Talent login data: name; date of birth; gender; address; tax identification number; telephone/mobile number; email address; photographs; physical characteristics; bank account number; CV; education/training certificates.
- C) CLIENTS
- Name; telephone/mobile number; email address; tax number; business name; address; bank account number.
2.3. 2.3. Data processed by Models Factory® includes:
a. Data provided by clients when services are contracted;
b. Data resulting from recruitment and employment processes, service provision, internships or volunteering;
c. Data resulting from the modelling representation process.
3. What are the purposes and legal bases for processing personal data?
Models Factory® processes personal data in accordance with the GDPR and related legislation for the following purposes:
a. Contract performance or pre-contractual steps (Article 6(1)(b) GDPR):
- (i) Service management and delivery, payments and invoicing;
- (ii) Customer support and communication;
- (iii) Service performance;
- (iv) Administrative management;
- (v) Payroll and benefits;
- (vi) Recruitment and spontaneous applications.
b. Legitimate interests (Article 6(1)(f) GDPR):
- (i) Service quality and satisfaction evaluation;
- (ii) Quality control and service improvement.
c. Legal obligations or public interest (Articles 6(1)(c) and 6(1)(e) GDPR):
As an employing entity, Models Factory® is subject to various legal obligations, as well as provisions related to the supervision of its activity (e.g., Social Security, IEFP – Institute for Employment and Vocational Training):
- (i) Information provision and response to authorities;
- (ii) Accounting and financial reporting;
- (iii) Tax and social security compliance;
- (iv) Record keeping for legal and regulatory purposes.
d. Consent (Article 6(1)(a) GDPR):
- (i) Sending of representation conditions;
- (ii) Submitting profiles to clients, casting agents, production companies and photographers;
- (iv) Collection of images, photos, audio or video.
4. Who are the recipients of the data?
- I) Data may be shared, as required, with:
- a) Social Security Financial Management Institute;
- b) Tax Authority;
- c) Banks and insurance companies;
- d) Payroll processors and HR service providers;
- e) Occupational Health and Safety services;
- f) Labour Authority (ACT);
- g) National Agency for Qualification and Vocational Education (ANQEP);
- h) Directorate-General for Employment and Labour Relations (DGERT);
- i) Institute for Employment and Vocational Training (IEFP);
- j) Third parties with the data subject’s explicit written consent or legitimate interest.
- k) Other entities to whom the data must be transmitted in order to comply with a legal obligation.
- II) Data from represented talents may be shared with:
Final clients, agencies, casting agents, production companies, and photographers within the scope of service provision. Data may be transferred to other EU or non-EU countries (including those without adequate data protection levels) strictly as required for fulfilling the above purposes.
Recipients may include:- Third parties: individuals or organisations legally authorised to process data;
- Processors: parties acting on behalf of the data controller.
5. What rights do data subjects have under the GDPR?
Data subjects have the following rights, which Models Factory® will fully respect:
- a) Right to information (Articles 13 and 14);
- b) Right of access (Article 15);
- c) Right to rectification (Article 16);
- d) Right to erasure (Article 17);
- e) Right to restriction of processing (Article 18);
- f) Right to object (Article 21);
- g) Right not to be subject to automated decision-making (Article 22);
- h) Right to data portability (Article 20);
- i) Right to lodge a complaint with a supervisory authority (Article 77).
Consent may be withdrawn at any time when processing is based solely on consent, without affecting the lawfulness of prior processing.

6. Is the provision of personal data mandatory?
Certain personal data are required, and without them, Models Factory® may not be able to provide the requested services.
7. How is personal data protected?
Models Factory® takes appropriate technical and organisational measures to safeguard personal data from destruction, loss, accidental or unlawful alteration, or unauthorised access.
All staff with access to personal data are bound by confidentiality agreements and receive training on proper data handling procedures.
8. How long is personal data retained?
A Data is retained for the duration necessary to fulfil contractual and legal obligations, in accordance with the GDPR.
Once no longer needed, data is deleted unless retained for:
- a) Legal retention obligations;
- b) Preserving evidence within statutory limitation periods (up to 20 years);
- c) Documentation for audits/inspections;
- d) Archival or historical purposes (with safeguards in place).
- e) Spontaneous applications (CVs) are kept for a minimum of 6 months and deleted within 12 months if not selected.
- f) For talents, data is retained during the contractual period and beyond, as required by tax, labour and commercial laws.
- g) For clients and suppliers, data is stored throughout the commercial relationship and afterwards as required by applicable legislation.
9. Can data subjects lodge a complaint with a supervisory authority?
Yes. If data subjects believe their rights under the GDPR have been violated, they may lodge a complaint with:

10. Declaration of awareness and consent
